Terms of service
GENERAL TERMS AND CONDITIONS OF SALE
These are the general terms and conditions of sale of Weber-Stephen Products (U.K.) Limited (hereinafter “WeberBlackstone”) for purchases on the website Blackstoneproducts.eu.
These general terms and conditions of sale (hereinafter the “Terms”) apply to all deliveries by Weber-Stephen Products (U.K.) Limited (hereinafter “WeberBlackstone”) via https://www.blackstoneproducts.eu/ to consumers (section 13 of the German Civil Code, BGB) and business customers (hereinafter collectively also referred to as “Customers”).
General Terms and Conditions of Sale of Weber-Stephen Products (U.K.) Limited
1 Definitions / contracting party
(1) A consumer is any natural person who enters into a legal transaction for a purpose that is predominantly outside their trade, business or self-employed professional activity.
(2) A business customer, by contrast, is any natural or legal person or partnership with legal capacity who, when entering into the contract, acts in the course of their trade, business or self-employed professional activity.
(3) The sales contract is concluded with Weber-Stephen Products (U.K.) Limited, Campus Reading International, Reading, RG2 6DA, United Kingdom.
You can contact our customer service team with questions, complaints and claims by telephone on +44 20 4603 4598 or by email at support@blackstoneproducts.eu.
(4) These Terms apply regardless of whether the Customer is a consumer, a business customer or a merchant within the meaning of commercial law.
(5) The version of the Terms in force at the time the contract is concluded shall apply.
2 Offers / ordering process / prices / conclusion of the contract
(1) WeberBlackstone accepts orders through the online shop. All agreements made between the Customer and WeberBlackstone in connection with the sales contract arise, in particular, from these Terms of Sale, WeberBlackstone’s written order confirmation and its declaration of acceptance.
(2) Customers can find details of the products offered by WeberBlackstone in the respective product descriptions.
(3) All product presentations in the WeberBlackstone online shop do not constitute legally binding offers to enter into a sales contract, but merely an invitation to place an order.
(4) The prices shown on the product pages are gross prices inclusive of statutory VAT and other price components. Shipping costs, where applicable, are charged separately.
(5) The non-binding ordering process in electronic commerce:
Once the Customer has found the desired product, they can add it to the virtual shopping basket without obligation by clicking the [Basket] or [Add to basket] button. The Customer can view the contents of the basket at any time without obligation by clicking [View basket] or [Basket]. Products can be removed from the basket at any time by clicking [Remove]. If the Customer wishes to purchase the products in the basket, they click [Proceed to checkout]. They can then view the order summary, check the information entered again and amend it if necessary.
The Customer then enters their details and selects the desired payment method.
(6) To place an order with an obligation to pay, the Customer clicks the “Buy now” button after entering all the information. By clicking [Buy now], the Customer declares that they have read and accepted the Terms, the information on the right to cancel and the Privacy Policy. Clicking [Buy now] completes the ordering process with an obligation to pay. After the purchase offer has been received, the Customer will immediately receive an email in which WeberBlackstone confirms receipt of the order (acknowledgement of receipt). This acknowledgement does not yet constitute acceptance of the Customer’s purchase offer. The acknowledgement of receipt alone does not create a contract. The conclusion of the contract is governed by section 2, paragraph (7), of these Terms.
(7) Conclusion of the contract in electronic commerce:
A sales contract for the products ordered by the Customer is concluded only when WeberBlackstone expressly accepts the purchase offer by sending an order confirmation by email (declaration of acceptance), or when WeberBlackstone dispatches the products to the Customer within two working days.
3 Dispatch / delivery / delivery costs
(1) Products are delivered only within the United Kingdom, either by parcel service or freight carrier. Delivery by freight carrier is used where the ordered product weighs more than 31.5 kg. In the case of freight delivery, WeberBlackstone will ask the Customer to provide a telephone number on which the carrier appointed by WeberBlackstone can contact the Customer to arrange delivery.
(2) Start of the delivery period for parcel deliveries
For payment in advance, the delivery period begins on the working day after the payment instruction is issued to the bank making the transfer. For other payment methods, the period begins on the working day after the contract is concluded. The Customer is informed of the delivery time on the relevant product page and before placing the order. If the last day of the period falls on a Sunday or an officially recognised public holiday at the place of delivery, that day is replaced by the next working day.
(3) Start of the delivery period for freight deliveries
For freight deliveries, the carrier will contact the Customer within three working days after receipt of payment to agree a delivery date, excluding Sundays and public holidays. The Customer is informed of the delivery time on the relevant product page and before placing the order. If the last day of the period falls on a Sunday or an officially recognised public holiday at the place of delivery, that day is replaced by the next working day.
(4) Unless otherwise agreed in an individual case, freight deliveries are made “to the kerbside”, meaning the public kerbside nearest to the delivery address.
(5) If the Customer orders several items with different delivery times in a single order, WeberBlackstone will dispatch the products in one combined shipment unless otherwise agreed. In this case, the delivery time for the item with the longest delivery time applies to the entire order.
(6) If not all ordered products are in stock, WeberBlackstone may make partial deliveries at its own expense, provided this is reasonable for the Customer. The respective delivery periods under section 3, paragraphs (2) and (3), of these Terms apply. No additional shipping costs will be charged.
(7) The Customer is informed of the delivery costs on the relevant product page and before placing the order.
(8) If products sent by freight carrier cannot be delivered at the agreed time for reasons for which the Customer is responsible, and a further delivery is possible only at additional cost, WeberBlackstone will inform the Customer of those costs. With the Customer’s agreement, WeberBlackstone will then carry out the further delivery. The Customer may demonstrate that WeberBlackstone incurred no costs or lower costs. If products sent by parcel service cannot be delivered for reasons for which the Customer is responsible, a notice will be left with information on the parcel collection point or locker where the products can be collected, the collection deadline and the return of the products to the sender if that deadline is missed. If delivery of the products fails through the Customer’s fault despite three delivery attempts, WeberBlackstone may withdraw from the contract. WeberBlackstone will refund any purchase price already paid by the Customer.
(9) If the ordered product is unavailable because WeberBlackstone has not received it from its supplier through no fault of its own, WeberBlackstone may withdraw from the contract. In this case, WeberBlackstone will inform the Customer immediately and may suggest delivery of a comparable product. If no comparable product is available or the Customer does not wish to receive a comparable product, WeberBlackstone will immediately refund any payments already made.
4 Payment terms / retention of title
(1) The Customer may use the payment options displayed in the online shop during the ordering process. The specific choice from the available payment methods is made before the order is placed with binding effect.
(2) If the Customer is in default of payment, the purchase price shall bear interest during the period of default at five percentage points above the base interest rate. WeberBlackstone reserves the right to demonstrate and claim compensation for a greater loss caused by the late payment.
(3) The delivered products remain the property of WeberBlackstone until payment has been made in full.
5 Gift cards
(1) The Customer may purchase one or more gift cards (hereinafter “gift card”) with different values in pounds sterling (GBP, £) from the Blackstone online shop. These gift cards may be used exclusively in the UK Blackstone online shop at www.eu.blackstoneproducts.com. For orders placed through the Blackstone online shop, the gift card is sent, after completion of the ordering process, to the email address provided during that process, together with a personal gift card code. The Customer can redeem gift card codes when placing an order in the Blackstone online shop under “Redeem gift card”. Several gift cards or codes can be combined and redeemed in a single order. Gift cards can only be redeemed before the ordering process is completed. Retrospective application is not possible.
(2) Gift cards may be redeemed against the purchase of all Blackstone products, except for the purchase of additional gift cards. The value of the gift card is deducted from the invoiced amount of the purchase.
(3) A gift card is valid for three years, beginning at the end of the year in which it was purchased. The balance expires at the end of the validity period and cannot be refunded in cash or in the form of a credit note.
(4) If the value of the gift card exceeds the invoiced amount, the remaining balance stays on the gift card until the end of its validity period and can be used for another purchase by entering the code again. Payment of the full or remaining gift card balance in cash is excluded. No interest accrues on the remaining balance.
(5) If the value of one or more gift cards or codes is insufficient to pay for the order, the difference can be paid using another payment method accepted by WeberBlackstone within the same ordering process.
(6) If the contract is reversed and the parties’ payments and products are returned, for example when products are returned under a statutory right to cancel, or if the purchased product is exchanged, the part of the purchase price paid by gift card will either be refunded to the respective gift card or gift cards, or made available as a new gift card balance for the remaining validity period. Any additional amount paid will be refunded through the payment method used.
(7) A gift card is transferable and may be used by any person in possession of it. Redemption in the Blackstone online shop is possible without prior identity verification.
(8) As WeberBlackstone cannot block a gift card or its code, its value cannot be replaced in the event of loss, theft or misuse of the gift card, or if the Customer provides an incorrect email address.
6 Contract text
For registered Customers, WeberBlackstone stores the contract text applicable at the time the contract is concluded. Under “View my order”, Customers can view their order history and order status.

Yusen Logistics (UK) Ltd
GP2 Cheaney Drive

(2) The voluntary contractual right of return offered by WeberBlackstone does not affect the Customer’s statutory rights. These continue to apply in full and independently of the right of return. In particular, the Customer’s statutory rights in respect of defects and the right to cancel remain unaffected.
(3) The following conditions apply to the exercise of the voluntary right of return: The Customer may return all products within thirty days of receipt, provided that the products are complete, unused and undamaged. Wherever possible, the products should be returned in their original packaging or equivalent packaging. To arrange a return, please contact our customer service team by telephone on +44 20 4603 4598 or by email at support@blackstoneproducts.eu. Our customer service team will provide return instructions and arrange the appropriate return transport. There is no online returns form. To meet the deadline for the voluntary thirty-day right of return, it is sufficient to send the products back within that period.
(4) If the products are returned in accordance with this voluntary right of return, WeberBlackstone will refund the purchase price to the Customer after receiving the products. WeberBlackstone will use the same means of payment used by the Customer for the original purchase transaction. No fees will be charged to the Customer.
9 Liability for defects
WeberBlackstone is liable for material defects and defects in title in the products delivered in accordance with applicable law, unless otherwise agreed in an individual case.
10 Guarantee
(1) WeberBlackstone grants its Customers a voluntary manufacturer’s guarantee for certain products. This does not affect the Customer’s ability to exercise statutory rights in respect of defects free of charge. Information about the guarantee conditions can be found on the product page for the relevant product covered by a manufacturer’s guarantee.
(2) The guarantee statement is supplied with the product.
(3) For business customers, the liability period for defects in products delivered by WeberBlackstone is one year from delivery.
11 Liability
(1) WeberBlackstone is liable to the Customer in all cases of contractual and non-contractual liability involving intent or gross negligence in accordance with statutory provisions.
(2) In other cases, subject to paragraph (3), WeberBlackstone is liable only for a breach of a contractual obligation whose performance is essential for the proper execution of the contract and on whose observance the Customer may normally rely (an essential contractual obligation). Liability is limited to compensation for foreseeable and typical loss. In all other cases, liability is excluded, subject to paragraph (3).
(3) WeberBlackstone’s liability for damage arising from death, personal injury or harm to health, and liability under the German Product Liability Act, remain unaffected by the above limitations and exclusions of liability.
12 Final provisions
(1) Contracts concluded between WeberBlackstone and the purchaser shall be governed exclusively by the laws of England and Wales. English shall be the exclusive language of the contract and negotiation.
(2) We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer dispute resolution board.
